Terms and Conditions
Last updated
These terms and conditions ("Terms") explain how you may use Rest Assured Homes (the "Service"). Please read them carefully. By creating an account, chatting with Amelia, listing a property or subscribing, you agree to these Terms and to our Privacy Policy.
1. Who we are
Rest Assured Homes.
In these Terms, "we", "us" and "our" mean the company above, and "you" means anyone using the Service.
2. What the Service is (and is not)
- Rest Assured Homes is an online platform that introduces people who want to sell property to people who want to buy it.
- We are not an estate agent, valuer, solicitor, mortgage adviser or financial adviser. Nothing on the Service is legal, tax, financial or valuation advice. Please take independent professional advice.
- We are not a party to any sale. Any agreement is made directly between the seller and the buyer. We do not guarantee that a property will sell, at what price, or how quickly, and we do not guarantee that any buyer is genuine or able to complete.
3. Your account
- You must be 18 or over and able to enter a binding contract.
- You sign in with a one-time code sent to your email address. Keep your email account secure and do not share codes with anyone. You are responsible for activity on your account.
- The information you give us must be accurate and kept up to date. If you register through a chat with Amelia, clicking the confirmation link in your email creates your account automatically.
- You can ask us to close your account at any time by letting us know via the contact us page.
4. Selling a property
- You must own the property or have the legal right to sell it, and you must be able to give us the information and photos you submit.
- A property enquiry made through Amelia is not shown to buyers until you confirm your email address and have agreed to share your details. It then stays on the portal for 90 days. You can edit, renew, deactivate or mark it as sold at any time.
- You may also add a property yourself for a one-off fee of £49.99, which keeps it on the portal for 90 days.
- You may upload up to 8 photos per listing, each up to 5 MB. When a listing is deactivated, sold, withdrawn or expires, its photos are permanently deleted.
- Choosing "quick sale" tells buyers you would consider a slightly reduced price for a fast sale. It is not an offer and does not oblige you to accept any price.
- Descriptions and photos must be accurate and must not mislead buyers.
5. Buying a property
- Browsing the summary of listings is free. A subscription of £29.99 per month gives you access to sellers' contact details and photos. The subscription renews monthly until you cancel.
- You may use seller information only to enquire about the property concerned, in a polite and lawful way. You must not copy, resell, scrape or publish it, and you must not use it for marketing unrelated to the property.
- You are responsible for checking the property, its title, condition and value, and for carrying out your own due diligence.
6. Payments, cancellation and refunds
- Payments are taken securely by Stripe. We never see or store your full card details. Prices include VAT where it applies.
- You can cancel a subscription at any time from the billing portal. It ends at the close of the period you have already paid for, and we do not charge you again.
- Your right to cancel: if you are a consumer you normally have 14 days from purchase to cancel. By starting to use the paid Service straight away you ask us to begin immediately, and if you then cancel within 14 days you may need to pay for the Service already used. This does not affect any rights you have under consumer law if the Service is faulty or not as described.
7. The AI assistant
Amelia is an automated AI assistant. She aims to be helpful and accurate, but she can make mistakes. Please check the summary she reads back to you before you confirm it, and correct anything that is wrong. Her replies are information only, not advice.
8. Acceptable use
You must not:
- give false, misleading or fraudulent information, or impersonate anyone;
- harass, pressure or exploit sellers or buyers, particularly people going through bereavement, illness, divorce or financial difficulty;
- upload anything unlawful, offensive, or that infringes someone else's rights, or photographs showing other people without their consent;
- interfere with the Service, attempt to gain unauthorised access, or use bots, scrapers or automated tools without our written permission;
- use the Service to send unsolicited marketing.
9. Content you provide
You keep ownership of the information and photos you submit. You give us a non-exclusive, worldwide licence to store, process, resize and display them on the Service for as long as your listing is live, and to operate and improve the Service. You confirm you have the right to give us this licence.
10. Our content and the Service
The Service, its design and its software belong to us or our licensors. You may use them only as these Terms allow. We work to keep the Service available but cannot promise it will always be uninterrupted or error-free, and we may change or withdraw features.
11. Third-party services
The Service relies on third parties, such as payment, email, storage, mapping and AI providers, described in our Privacy Policy. We are not responsible for third-party websites or services.
12. Our responsibility to you
- Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited. Your statutory consumer rights are not affected.
- Subject to that, we are not liable for losses arising from a property sale or purchase, for the conduct of other users, for loss of profit or opportunity, or for losses we could not reasonably have foreseen. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim.
13. Suspending or ending access
We may suspend or close an account or remove a listing if you break these Terms, if we reasonably suspect fraud or misuse, or if we are required to by law. Where we reasonably can, we will tell you why.
14. Changes to these Terms
We may update these Terms from time to time. The date at the top of this page shows when they last changed. If we make a significant change we will tell you in advance. Continuing to use the Service after a change means you accept the new Terms.
15. Complaints, law and courts
If you are unhappy, please tell us via the contact us form and we will do our best to put it right. These Terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction, although if you live in Scotland or Northern Ireland you may also bring proceedings in your local courts.
